1. Acceptance of Terms

By accessing or using the Data TB platform, APIs, downloadable local tools, and related services (collectively, the "Services"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not access or use our Services.

2. Description of Service & Zero Data Store Architecture

Data TB provides a software-as-a-service platform that facilitates the migration, backup, and restoration of cloud data between third-party providers.

Important Architecture Notice:

We operate exclusively on a Zero Data Store Architecture. Data TB is an orchestration and routing engine. We do not store, host, or cache your underlying payload data (files, emails, databases) on our infrastructure. Your data streams directly between the source and destination or your local storage.

3. User Responsibilities & Data Sovereignty

Because Data TB does not store your data, you acknowledge and agree that:

  • Authorization: You must have explicit, legal authorization to access, transfer, and copy data from the source environment to the destination environment.
  • Local Backups: For direct-to-local backups, you are solely responsible for the security, redundancy, and integrity of the local storage environments where the data is written.
  • Compliance: You are responsible for ensuring that your data transfers comply with all applicable regional and industry-specific regulations (e.g., GDPR, HIPAA).

4. Third-Party Account Access

To use the Services, you must grant Data TB temporary API access to your third-party cloud accounts via standard OAuth protocols or secure API keys. You can revoke this access at any time through the respective third-party provider dashboards. We are not responsible for downtime, throttling, or API changes enforced by these third-party services.

5. Downloadable Tools

For specific features, such as our tool-based restore functionality, we provide downloadable software for local installation. You are granted a revocable, non-exclusive, non-transferable license to use this software solely in conjunction with the Data TB Services. You may not reverse engineer, decompile, or distribute these tools.

6. Limitation of Liability

To the maximum extent permitted by law, Data TB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data loss during transfer, or business interruption, arising out of or related to your use of the Services, even if advised of the possibility of such damages.

7. Changes to Terms

We reserve the right to modify these Terms of Use at any time. We will provide notice of significant changes via the platform or email. Continued use of the Services after such modifications constitutes your acceptance of the revised Terms.
